1. Acceptance of Terms
Welcome to Wild Acres Farmstead LLC (“Wild Acres Farmstead,” “we,” “us,” or “our”). By accessing our website or purchasing products from our online store, you (the user or customer) agree to be bound by the following Terms of Use. Please read these terms carefully before using our site or services. If you do not agree with any part of these Terms, you should discontinue use of our website.
2. Accounts and Eligibility

Account Creation: Creating an account on our site is optional. If you choose to register, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

This right to terminate accounts at any time and without explanation is important for protecting our business..
3. Permitted Use and Prohibited Conduct
You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, lawful purposes (such as browsing products or placing orders). You agree not to misuse our site. In particular, you shall not:

Violating the above rules may result in immediate termination of your access to the site without notice. These “house rules” help us maintain a safe e-commerce environment.
4. Products, Pricing, and Availability
Product Descriptions: We strive to describe and display our products as accurately as possible. However, Wild Acres Farmstead does not guarantee that all product descriptions, photographs, pricing, or other content on our site are complete, current, or error-free. Colors and textures of products (such as handmade soaps or candles) may appear slightly different in person than on your screen due to display differences. Minor variations in weight, color, or appearance are normal for handcrafted items and do not indicate a defect.
Product Availability: All products (including livestock and farm goods) are subject to availability. We reserve the right to limit quantities of any products or to discontinue any product at any time without notice. Placing an item in your cart or wish list does not guarantee it will be available at checkout. If an item becomes unavailable after you place an order, we will notify you and, if payment was processed, issue a refund or discuss alternative options. Wild Acres Farmstead also reserves the right to refuse or cancel any order if, for example, a product is out of stock or if we suspect misuse of our site or an erroneous listing.
Pricing: All prices on our site are listed in U.S. Dollars (USD). Prices and promotions are subject to change at any time without prior notice. Despite our best efforts, a small number of products may be mispriced. We do not guarantee that our pricing is error-free, and we reserve the right to correct any pricing errors. If we discover a pricing error:

If an item's correct price is lower than the stated price, we may charge the lower amount and ship you the item.

If an item's correct price is higher than our stated price, we may cancel your order and notify you of the cancellation, or contact you with instructions depending on your preference. We have no obligation to provide a product to you at an incorrect (lower) price, even after you have received an order confirmation, if the pricing error is obvious and could reasonably have been recognized by you as a mistake. (For example, a $100 product listed for $1 is an apparent error.)
Promotions and Discounts: Any special offers, discounts, or coupon codes are subject to their own terms. We reserve the right to end promotions early or disallow a discount code if we determine it is being misused or is no longer valid. Only one promotion may apply per order, unless explicitly stated otherwise.
5. Orders and Payment Terms
When you place an order on our website, you are making an offer to purchase the products in your cart, subject to these Terms.

Order Confirmation: After you submit an order, we will send a confirmation email summarizing the items ordered and shipping address. This email confirms receipt of your order request but does not signify our acceptance of your order. We formally accept your order (and form a contract of sale) only when we charge your payment method and dispatch the product. We reserve the right to refuse or cancel any order for reasons including errors in product information, suspected fraud, or unforeseen supply issues.

Payment Processing: Payment must be made at the time of order placement. We accept major credit/debit cards and other payment methods as indicated at checkout. All online payments are processed securely through our third-party payment processors (such as Square, Wix Payments, and PayPal). By completing a transaction, you agree to abide by the payment provider’s terms and conditions (e.g., Square’s, PayPal, and Wix Payments' Terms of Service). Your financial information is handled securely; Wild Acres Farmstead does not store full credit card numbers on our servers. We are not responsible for delays in processing or errors caused by PayPal’s services or account verification steps. Disputes arising specifically from the use of PayPal must be addressed with PayPal directly unless the issue relates to a product purchased from us.

Billing Information: You agree to provide current, complete, and accurate purchase and account information for all orders. Promptly update your account or payment information (billing address, email, credit card number, expiration date) so we can complete your transactions and contact you as needed. If we cannot process payment with the information you provided, we may attempt to contact you. Failure to promptly resolve payment issues may result in order cancellation.

Pricing Changes: Prices for our products are subject to change. Any new prices will not affect orders that have already been placed and accepted. In the event of a website pricing error or technical glitch, Wild Acres Farmstead reserves the right to cancel or adjust orders affected by such errors (with a refund if applicable), as described in Section 4 above.

Taxes: All prices exclude any applicable sales tax. If sales tax applies to your order, it will be calculated and added at checkout according to the shipping destination’s laws and rates.
6. Shipping and Delivery
Use of our website for purchases is also subject to our Shipping Policy, which is incorporated herein by reference. Below is a summary of key shipping terms (see the full Shipping Policy for details):

Shipping Locations: At this time, Wild Acres Farmstead ships orders only within the United States. We do not offer international shipping. We also do not ship live animals; pickup arrangements for livestock may be made separately (as described in product listings).

Processing Time: Orders are typically processed and shipped out within 1–3 business days (Monday through Friday, excluding holidays) after payment is received. If there is any significant delay (e.g., an unexpected stock issue), we will contact you via email.

Carriers and Methods: We use reputable carriers such as USPS, UPS, or FedEx. The choice of carrier and service (ground, priority, etc.) depends on the order’s weight, size, and destination – we select the option that best balances speed and cost. You will receive a shipment notification email with a tracking number once your order is dispatched.

Delivery Estimates: Typical transit times vary by destination and shipping method, usually ranging from 2 to 7 business days within the continental US. However, all delivery times are estimates and not guaranteed. Once we hand your package over to the carrier, we cannot guarantee it will arrive within a specific timeframe, as delays can occur due to weather, carrier issues, or other factors beyond our control.

Transfer of Risk: Title to products and risk of loss pass to you upon our delivery of the order to the carrier. Wild Acres Farmstead is not responsible for delays, loss, or damage in transit after we ship the order. If a shipment is significantly delayed or goes missing, please contact the carrier with your tracking number for assistance. We will do our best to help you resolve shipping issues, but we are not liable for carrier failures.

Shipping Charges: Shipping costs are calculated at checkout based on the weight and dimensions of your items and the delivery address. You will see the shipping charges before finalizing your order. Customers are responsible for all shipping fees unless a free shipping promotion or flat-rate shipping offer is explicitly applicable at the time of purchase. Any such promotions will be clearly indicated on our site or at checkout.

Incorrect Addresses: Please ensure your shipping address is entered correctly. We are not responsible for packages delivered to an incorrect or invalid address provided by the customer. If an order is returned to us due to an address error or delivery failure, we will contact you to arrange reshipment (additional shipping charges may apply) or a refund of the purchase price minus shipping costs.

7. Return and Refund Policy
Purchases made on our website are subject to our Return & Refund Policy, which is incorporated into these Terms. We summarize key points here (see the full Return & Refund Policy below for complete details):

Return Window: If you are not satisfied with a non-perishable, eligible product, you may request a return within 14 days of the delivery date. Beyond 14 days from delivery, we generally cannot offer a return or refund.

Condition of Items: To be eligible for a return, items must be unused, in the original packaging, and in resalable condition. This means the product shows no signs of use, wear, or damage, and includes all parts/accessories. We reserve the right to refuse returns of items that do not meet these conditions (e.g., items that are used, altered, or missing components).

Non-Returnable Items: Certain categories of products cannot be returned or refunded. Specifically, perishable goods (such as food products) and live animals or livestock are final sale and excluded from returns. Due to their nature, we do not accept returns on these items (except in cases of a clear mistake on our part). Additionally, any item that is made-to-order or personalized (if offered) and gift cards (if offered) are non-refundable. Any clearance or “final sale” items will be identified as such on our site and are ineligible for return.

Return Process: To initiate a return, you must first contact us at returns@wildacresfarmstead.com with your order number and the reason for return. We will provide return instructions and a return authorization if your item is eligible. Do not send back items without first obtaining authorization, as unauthorized returns may be refused. Unless the return is due to our error (e.g., we sent the wrong item), you are responsible for return shipping costs. We recommend using a trackable shipping service for any returns, and purchasing shipping insurance for higher-value items. We cannot guarantee that we will receive your returned item, so tracking is important.

Return Shipping Costs: If the return is due to a defect or error on our part (e.g., you received a wrong or defective item), we will cover or reimburse reasonable return shipping costs. In all other cases, the customer is responsible for paying the cost of return shipping, and original shipping charges (the cost to send the item to you) are non-refundable. For example, if you paid $10 for shipping on your order, that $10 will not be returned to you as part of the refund unless the return is due to our mistake.

Refunds: Once we receive and inspect your returned item, we will notify you of the approval or rejection of your refund. If approved, we will process the refund to your original method of payment. Please note it may take a few business days for the refund to appear on your account, depending on your bank or card issuer. If your return is not approved (for example, if the item returned is not in acceptable condition), we will notify you and no refund will be issued, and you may choose to have the item shipped back to you at your expense.

Exchanges: We do not offer direct product exchanges except for instances of damaged or defective items. If you received a defective or incorrect item, please see “Damaged or Defective Items” below. For a different size or variant, please initiate a return (if eligible) and place a new order for the desired item.

Damaged or Defective Items: Please inspect your order upon delivery. If you receive an item that is defective, damaged, or incorrect, contact us immediately at support@wildacresfarmstead.com or returns@wildacresfarmstead.com. Provide details and photos if possible. We will work with you to correct the issue, which may include sending a replacement or issuing a refund. Note: Minor cosmetic imperfections that do not affect product function—such as small surface cracks in soaps or candles due to shipping, or slight variations in color/texture—are considered normal for handcrafted products and are not regarded as defects for return purposes. These minor variations will not qualify for a refund or replacement.

8. Intellectual Property Rights
All content and materials on the Wild Acres Farmstead website – including text, descriptions, product images, graphics, logos, button icons, videos, audio clips, and software – are the property of Wild Acres Farmstead LLC or our content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws. This includes the Wild Acres Farmstead name and logo, which are our trademarks/service marks.
By using our site, you agree that you will not copy, reproduce, distribute, republish, download, display, post, or transmit any content from our site without our prior written permission, except for your own non-commercial use (such as printing a copy of an order confirmation or product description for personal reference). Any unauthorized use of our intellectual property or the website’s content is strictly prohibited. We reserve all rights not expressly granted to you in these Terms.
If you are a journalist, blogger, or reviewer interested in our products, please contact us for permission to use images or content. We generally welcome press coverage but require that our brand assets be used appropriately.
9. Disclaimer of Warranties
Wild Acres Farmstead provides the website, its content, and all products on an “as is” and “as available” basis, without any warranties of any kind, express or implied, except as expressly stated otherwise. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Any material or information downloaded or otherwise obtained through the use of our site is accessed at your own discretion and risk. You will be solely responsible for any damage to your device or loss of data that results from obtaining any content from the site.
Wild Acres Farmstead does not guarantee the accuracy or completeness of any information on the site. We specifically disclaim any representation or warranty that the content on our site (including product descriptions or pricing) is accurate, complete, reliable, current, or error-freeprivacypolicies.com. While we make reasonable efforts to correct any errors or omissions as soon as they are identified, we make no guarantees regarding any content.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our warranties are limited to the minimum scope permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Wild Acres Farmstead LLC and its owners, officers, employees, affiliates, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website or purchase/use of any products, even if we have been advised of the possibility of such damages. This includes, without limitation, damages for loss of profits or revenue, loss of data, loss of goodwill, replacement costs, or any other intangible losses.
In no event shall our total liability to you for all claims regarding your use of the site and purchases made through it exceed the amount you paid to Wild Acres Farmstead for the specific product or service in question. For example, if you purchased a product for $50 and it gave rise to a claim, our maximum liability would be $50. We are not liable for any loss or injury that is not reasonably foreseeable.
Use of Livestock and Farm Products: By purchasing any live animal (such as livestock) or perishable farm product from us, you assume all responsibility and risk once the item is in your possession. All livestock sales are final, and Wild Acres Farmstead is not liable for the health or fitness of an animal once it leaves our farm (we ensure animals are healthy at pickup, but we cannot control conditions thereafter). Likewise, food products (meats, produce) should be handled and prepared safely; we are not responsible for any illness or injury resulting from improper storage or cooking after delivery.
These limitations apply to the fullest extent permitted by law and survive even if any remedy fails of its essential purpose. Certain state laws do not allow limitations on implied warranties or exclusion of certain damages; if those laws apply to you, some of the above limitations may not apply.
11. Indemnification
You agree to indemnify, defend, and hold harmless Wild Acres Farmstead LLC, and its officers, owners, employees, affiliates, and agents, from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of this website or any products purchased from Wild Acres Farmstead; (b) any breach or violation of these Terms of Use by you; (c) your violation of any law or regulation or the rights of any third party; or (d) content you submit or share through our website (e.g., product reviews or comments). This means that if a third party sues us because of something you did in violation of these terms or applicable law, you may be responsible for any costs or damages we incur as a result. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claim. You will not settle any claim subject to this indemnification provision without our prior written consent.
12. Governing Law
These Terms of Use and any separate agreements whereby we provide you services or sell you products shall be governed by and construed in accordance with the laws of the State of Indiana, USA, without regard to its conflict of law provisions. This governing law applies no matter where you are located, meaning that the laws of Indiana will apply to any disputes arising under these Terms or related to your use of the site or our products.
If you are accessing the site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
13. Dispute Resolution
We hope to resolve any customer concerns or disputes amicably through our customer service team. However, if a dispute arises that cannot be resolved informally, the following terms will apply:
Binding Arbitration: Any dispute or claim relating in any way to your use of the Wild Acres Farmstead website or to any products or services sold or distributed by Wild Acres Farmstead through the site shall be resolved by binding arbitration, rather than in court. By agreeing to these Terms, you and Wild Acres Farmstead both waive the right to a trial by jury or to participate in a class action for such claims. Arbitration is more informal than a lawsuit in court and uses a neutral arbitrator instead of a judge or jury. It allows for more limited discovery than in court, and is subject to limited review by courts.
Arbitration Procedure: The arbitration will be administered by a reputable arbitration organization (such as the American Arbitration Association, AAA) under its Consumer Arbitration Rules. The arbitration may be conducted by telephone, written submissions, or in person in the county of your residence or another mutually agreed location. The seat or legal location of the arbitration shall be Indiana, meaning that the arbitration will be subject to Indiana law. The arbitrator will have the authority to award the same damages and relief that a court could, including injunctive and declaratory relief or statutory damages, but only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Exceptions: Small Claims Option – Either you or Wild Acres Farmstead may choose to bring an individual action in small claims court for disputes or claims within the scope of that court’s jurisdiction, instead of proceeding with arbitration. Intellectual Property – Disputes relating to intellectual property rights (such as trademarks, trade dress, copyrights, or patents) may be resolved in court rather than arbitration. Equitable Relief – Either party may seek injunctive or equitable relief in a court of proper jurisdiction to prevent an imminent breach of these Terms that would cause irreparable harm (for example, misuse of intellectual property or confidential information).
Class Action Waiver: All disputes will be resolved on an individual basis only. Neither you nor Wild Acres Farmstead shall be entitled to join or consolidate claims by or against other customers, or pursue any claim as a representative or class action, or in a private attorney-general capacity. The arbitrator can award relief only on an individual basis (to satisfy an individual’s claim) and may not award relief for or against anyone who is not a party to the arbitration. If a court of competent jurisdiction finds that any part of this class action waiver is unenforceable or invalid, then the entire arbitration clause (except for this sentence) shall be null and void, but the remainder of the Dispute Resolution section will remain in effect.
Opt-Out Right: You have the right to opt out of the binding arbitration and class action waiver provisions by sending written notice of your decision to opt out to our mailing address (provided in the Contact Us section) within 30 days of first accepting these Terms & Conditions. The opt-out notice must include your name, address, email, and an unequivocal statement that you opt out of the arbitration agreement. If you opt out of arbitration, you are agreeing that any claim that arises must be resolved exclusively by a state or federal court located in the State of Indiana, and you consent to venue and personal jurisdiction in those courts.
Governing Law in Arbitration: For clarity, the arbitrator shall follow the substantive law of the State of Indiana (including its statutes of limitations and applicable standards of liability) and applicable federal law (for example, the Federal Arbitration Act) in resolving any dispute. The arbitrator shall honor claims of privilege recognized by law and shall provide a brief written explanation of the award if requested by either party.
This Dispute Resolution section (including the arbitration agreement and class action waiver) is an essential part of these Terms & Conditions and shall survive any termination of your account or your use of the site.
(Note: By agreeing to these Terms, you explicitly acknowledge that you have read and understand this agreement to arbitrate and the class action waiver, and that you voluntarily agree to these terms.)
14. Changes to These Terms
Wild Acres Farmstead reserves the right to modify or update these Terms & Conditions at any time. If we make material changes, we will notify users by updating the “Last Updated” date at the top of this page and/or by other means (such as a notice on our homepage or via email notification to account holders, if appropriate). It is your responsibility to review these Terms periodically for any updates or changes. Your continued use of the website following the posting of changes constitutes acceptance of those changes. If you do not agree to any amended terms, you should stop using the site and (if applicable) cancel your account.
15. Miscellaneous
Entire Agreement: These Terms of Use (along with any policies or documents incorporated by reference, including our Privacy Policy, Return & Refund Policy, and Shipping Policy) constitute the entire agreement between you and Wild Acres Farmstead regarding your use of the site and supersede any prior agreements or understandings, whether written or oral, relating to the same subject matter.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Wild Acres Farmstead.
No Third-Party Beneficiaries: These Terms are intended for the benefit of you and Wild Acres Farmstead and no third party shall have any rights to enforce any terms herein, except as may be expressly provided by law.
