Privacy Policy

Last Updated: May 4th, 2025

1. Introduction

Wild Acres Farmstead ("Wild Acres", "we", "us", or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy describes how we collect, use, share, and safeguard personal information when you visit our website or use our services (collectively, the "Site"). It also explains your rights regarding your personal information and how you can contact us to exercise those rights.

By using our Site, you agree to the terms of this Privacy Policy. If you do not agree with our practices, please do not use the Site. This policy applies to information collected by Wild Acres Farmstead through the Site and any related services or communications. (Note: Our Site may contain links to third-party websites or services; if you follow those links, be aware that those third parties have their own privacy policies, and we are not responsible for their content or practices.)

2. Information We Collect

We collect both information that you voluntarily provide to us and information that is collected automatically when you interact with our Site.

3. Personal Information You Provide

We may collect personal information that you choose to provide when you engage with Wild Acres Farmstead, such as:

  • Making a Purchase or Placing an Order: When you use our Wix-powered online store to buy products, we collect information necessary to process the transaction. This includes your name, email address, billing address, shipping address, and phone number (optional). You will also provide payment information, but payment details (like credit card numbers) are processed securely by our payment providers (Wix Payments, Square, and PayPal) and are not stored on our servers. We receive confirmation of your payment and may receive limited information like the card type and last four digits, but we do not see or retain your full credit card number or security code. For more information on how PayPal, Wix, or Square handles your data, please review their Privacy Statements. By choosing PayPal, Wix Payments, or Square as your payment method, you agree to their respective privacy terms in addition to ours.

  • Creating an Account or Subscribing: If our Site offers user accounts or if you subscribe to our newsletter/blog, we will collect information such as your name, email address, and a password for your account. (Passwords are stored in encrypted form by the Wix platform.) We may also collect preferences or interests you share with us (for example, your preference to receive certain types of content).

  • Contacting Us or Filling Out Forms: If you contact us through a form on the Site (such as a contact form or order inquiry form), via email, or by phone, we collect the information you provide. This typically includes your name, email address, phone number (if you provide it), and the content of your message or any attachments. Similarly, if you leave a comment on our blog (via the Wix Blog app), any information you post (including your name/username and the comment itself) will be collected.

  • Participating in Promotions: From time to time, we may run promotions, contests, or special offers. For example, you might encounter a pop-up (powered by Promolayer) offering a discount in exchange for signing up with your email. If you choose to participate, we will collect the information requested (often your name and email address) to administer the promotion (e.g., to send you a coupon code or add you to our mailing list). We will also record that you participated, so we don’t present the same offer to you repeatedly.

We will clearly indicate when information is required (for example, to fulfill an order) and when it is optional. You may choose not to provide optional personal information; however, certain features of the Site (such as completing a purchase or subscribing to a newsletter) may not be available if you decline to provide required information.

4. Information Collected Automatically

When you visit or interact with our Site, we (and our third-party partners) automatically collect certain information about your device and your use of the Site. This passive data collection includes:

  • IP Address: We log your Internet Protocol (IP) address when you visit the Site. The IP address can indicate your general location (such as city or state) and is used for purposes like detecting potential fraudulent activity, protecting our Site from security threats, and gathering aggregate demographic information.

  • Device and Browser Details: We collect information about the device and browser you use to access the Site. This may include data such as your browser type and version, device type (e.g., desktop, mobile), operating system, language preference, and screen resolution. This information helps us ensure the Site is optimized for different devices and troubleshoot technical issues if they arise.

  • Usage Data: We collect information about how you navigate and use our Site. This can include the pages or products you view, the amount of time spent on pages, the links you click, the date and time of your visits, the page that referred you to our Site (for example, a search engine or a social media link), and other analytics data. This information is typically collected via cookies and similar technologies (described below) and helps us understand which content is most useful to our visitors, so we can improve our offerings.

  • Cookies and Similar Technologies: Like most websites, we use cookies, beacons, scripts, and other tracking technologies to collect information as you browse. Cookies are small text files placed on your browser or device that store data about your visit. These technologies may collect information such as your unique device identifier, browser behavior, and preferences. For example, cookies help us keep you logged in during your visit, remember items in your shopping cart, and recognize you when you return. They also allow us to gather analytics about Site usage (e.g., which pages are visited most) and may be used for security purposes (e.g., protecting against malicious activity). Some cookies are set by us, and some may be set by third-party services that are integrated into our Site (such as Wix’s analytics or Promolayer’s functionality). For more details on cookies, see the Cookies and Tracking Technologies section below.

Information collected automatically is generally statistical data about our users' browsing actions and patterns, and it helps us administer and improve our Site. Some of this data may be linked to personal information (for instance, if you are logged into an account, analytics might be tied to your user profile), but we do not use automatically collected data to identify you individually without also having other personal information from you.

5. Cookies and Tracking Technologies

Cookies and similar tracking technologies are an important part of how we run our website and provide a user-friendly experience. This section explains how we use these tools and what choices you have.

What Are Cookies?
Cookies are small pieces of data stored on a site visitor's browser. They are typically used to keep track of settings and actions on a website. For example, cookies can remember your login status, what’s in your shopping cart, or your preferences such as language and region. Web beacons (also known as pixel tags or clear GIFs) are tiny graphics embedded on webpages or emails that track whether you’ve viewed certain content. Similar technologies also include scripts or local storage that can recognize your device.

How We Use Cookies:
Wild Acres Farmstead and our service providers (like Wix and Promolayer) use cookies and similar technologies for a few key purposes:

  • Essential Cookies: These cookies are necessary for the Site to function properly. They enable core features such as user login, shopping cart functionality, and secure checkout. For example, when you add items to your cart or proceed through checkout, cookies allow those actions to persist as you navigate the Site. Without these, the store and other basic features might not work correctly.

  • Analytics and Performance: We use cookies to understand how visitors use our Site. This helps us monitor traffic, understand usage patterns, and improve our content and layout. For instance, Wix or other analytics tools may place cookies that collect aggregated information on which pages are visited, how long users stay, and how they arrived at our Site. The information collected is generally anonymized and used for statistical purposes – we look at trends and metrics, not at individual behavior per se.

  • Preferences and Functionality: These cookies help us remember your preferences and enhance your experience. For example, if our Site offers the ability to save your login or remember your preferences (like a wish list or items viewed), cookies allow that memory between sessions. They can also remember if you’ve already seen a notification or pop-up so we don’t show it to you again.

  • Promotional/Marketing: Currently, we do not host third-party ads on our Site, so we do not use advertising cookies that track you across different sites for targeted advertising. However, we may use cookies to promote our own products or offers to you. For instance, Promolayer (our pop-up tool) might use a cookie to determine if you’ve already signed up for our newsletter, so it knows whether or not to show you a sign-up pop-up. These types of cookies are only used in relation to Wild Acres Farmstead promotions and do not involve third-party advertisers.

Third-Party Cookies: As mentioned, some cookies on our Site are placed by third-party services that we use. For example:

  • Wix, our website host, uses cookies to ensure site stability, security, and to collect analytics on our behalf.

  • Promolayer may set cookies to manage pop-up frequency and effectiveness (e.g., ensuring the same offer isn’t shown too often).

  • If in the future we integrate other tools (like an email newsletter service or social media sharing features), those providers might set their own cookies as well. We will update our policy if new significant cookies are introduced.

These third-party cookies are governed by the privacy policies of the third-party providers. However, we only integrate third-party tools that we trust and that are there to enhance user experience or help us run our business.

Your Choices Regarding Cookies:

When you first visit our Site, you may see a notice about cookies. By continuing to use the Site, you consent to the placement of cookies as described. You have the right to control or limit how cookies work on your device. Here are some ways to manage cookies:

  • Browser Settings: Most web browsers allow you to refuse new cookies, disable existing cookies, or alert you when new cookies are being sent to your device. Please refer to your browser’s help section for instructions on how to do this. Keep in mind that if you disable or delete cookies, some features of our Site (and other websites) may not function as intended. For example, if you disable all cookies, you may not be able to complete a purchase because the cart may not remember your items.

  • Cookie Banner (if applicable): We may implement a cookie consent banner on our Site (via Wix’s Privacy Center or a similar tool) which gives you the option to accept or decline certain categories of cookies (e.g., only essential cookies vs. all cookies). If this banner is present, you can make your choice when first visiting the Site, and you can usually update your preferences by clicking a “Cookie Settings” link (often found in the footer).

  • Do Not Track: Some browsers have a "Do Not Track" (DNT) feature that sends a signal to websites indicating you do not want to be tracked. Currently, our Site does not respond differently to DNT signals – we operate under the terms of this Privacy Policy for all users, and if you wish to limit tracking, using your browser’s cookie controls is the best approach.

For more detailed information about cookies and how to manage or disable them, you can visit independent resources like AllAboutCookies.org. Remember that rejecting cookies may impact your ability to use certain features of our Site, but it will not prevent you from making basic use of the Site (browsing products, reading content, etc.).

6. How We Use Your Information

We use the personal information we collect for a variety of purposes necessary to run our business and provide services to you. Below are the main ways in which Wild Acres Farmstead uses your information:

  • To Process Transactions and Provide Services: We use your information to fulfill orders and requests. For example, we use your personal details to process payments (through our secure payment processors), to package and ship your orders to your address, and to provide you with order confirmations and receipts. We also use it to provide any services you request – such as creating an account or saving your wish list.

  • To Communicate with You (Service and Support): We may use your contact information to communicate with you about your orders or account. This includes sending you status updates (e.g., order confirmation, shipping notification), responding to inquiries or customer support requests, and notifying you of important changes or issues (like updates to our terms or privacy policy, or information about product recalls if that ever were relevant). These communications are typically transactional or relationship messages and are not promotional in nature.

  • For Marketing and Promotional Purposes: With your consent or as otherwise permitted by law, we use your information (primarily your name and email) to send you marketing communications. For example, if you sign up for our newsletter or if you make a purchase (and have not opted out of marketing), we may send you emails about new products, farm news, special offers, or upcoming events at Wild Acres Farmstead. We do not bombard our customers, but occasional updates may be sent. You can opt out of these communications at any time (see Your Rights and Choices below for how to unsubscribe). If we ever decide to run targeted advertising for our own products (for instance, showing ads on other platforms to people who visited our Site), we would use data in aggregate or hashed form and ensure compliance with relevant laws – and we would update this policy to reflect that activity.

  • To Improve and Personalize our Site and Services: We use the information (particularly aggregated data and analytics, as well as feedback you provide) to understand how our Site is used and how we can make it better. This might include troubleshooting and debugging technical issues, analyzing user behavior to see where our Site could be more user-friendly, and personalizing your experience. For example, if we notice many users from a particular region, we might highlight relevant content for that region. Or if analytics show our checkout process has a high drop-off at a certain step, we know to investigate and improve that step. Additionally, if you are logged in or have provided info, we might tailor content for you (such as recommending products similar to those you viewed or bought).

  • To Ensure Security and Prevent Fraud: We use information to keep our Site, business, and users safe. For instance, we may use IP addresses and device information to detect potential malicious activity. We also may use purchase history and other indicators to flag and investigate fraudulent transactions. If you attempt something that we suspect is fraudulent or violates our terms, we may use personal information to investigate and take action.

  • To Comply with Legal Obligations: We are required to comply with various laws and regulations, and we may need to use or preserve your information for legal reasons. For example, we keep transaction records for accounting and tax purposes. We might also use and disclose information as required to respond to lawful requests by public authorities (e.g., to comply with a subpoena or court order), or to meet record-keeping obligations under consumer protection laws. If you exercise certain privacy rights, we will use your information to document our response to your request.

We will not use your personal information for purposes that are unrelated to the reasons we collected it, unless we obtain your consent or have another legal basis for doing so. If we plan to process your personal data for a purpose that is different from the purpose we collected it for, we will provide you with information about that secondary purpose and, if required, ask for your consent.

7. How We Share Your Information

Wild Acres Farmstead understands the importance of keeping your personal information private. We do not sell your personal information to third parties. We do, however, share certain information with third parties in the following circumstances, to run our business and provide our services to you:

  • Service Providers (Processors): We share your information with trusted third-party companies that provide services to us, such as website hosting, payment processing, email service, and marketing tools. These service providers are bound by contracts that limit their use of your data to the purposes we specify and require them to protect it. Our key service providers include:

    • Wix.com (Website Platform): Our website (including the online store and blog) is built and hosted on the Wix platform. Wix provides the infrastructure that allows us to operate the Site. As a result, information that you provide through our Site (such as account information, form submissions, and order details) is stored on Wix’s servers. Wix may process this data on our behalf (for example, storing it in databases, backups, etc.). Wix implements security measures to protect your data (such as firewalls and encryption) and is obligated under their terms and applicable law to keep your information confidential. For more details on how Wix handles data, you can refer to Wix’s Privacy Policy (but note that your data on our Site is controlled by Wild Acres Farmstead).

    • Payment Processors (Wix Payments/Square/PayPal): We use external payment gateways to handle credit card and other payment transactions. When you make a purchase, your payment details are transmitted directly to these payment processors. They use your information (such as credit card number, expiration date, CVV, and billing address) to process the transaction. These processors (including Wix Payments, PayPal, and Square) are PCI-DSS compliant, meaning they adhere to the Payment Card Industry Data Security Standards, which are strict industry standards for protecting payment information. Wild Acres Farmstead does not store your sensitive payment card information on our own systems. We receive a confirmation once your payment is approved, and we may retain some transaction details (like amount, date, and last four digits of your card) for our records. The payment processors are authorized to use your information only as needed to process transactions and comply with applicable laws. (For more information, see PayPal Privacy Statement, Square’s Privacy Notice, and Wix’s payments privacy info in their policy.)

    • Troubleshooting Transactions: If a customer experiences a payment issue and contacts us for support, we may share limited identifying information (such as the PayPal account email address provided during checkout) with the relevant payment processor solely for the purpose of troubleshooting or resolving the issue. This is done only with processors already authorized by the customer (e.g., PayPal or Square) and only as needed to fulfill or support the transaction.

  • Promolayer (Pop-up and Marketing Tool): We use Promolayer (integrated via Wix) to create pop-ups, email sign-up forms, and special offer banners on our Site. When you interact with a Promolayer form (for example, entering your email to get a coupon or join our newsletter), the information you input is collected through Promolayer’s system and then passed to us (often into our Wix Contacts list or connected email list). Promolayer may also use cookies (or similar tech) to remember your interaction (so it knows, for example, not to show you the same offer repeatedly after you’ve signed up). Promolayer acts as a service provider to us: it collects and stores data solely to help us engage with you (e.g., collecting your email for our newsletter) and not for its own independent purposes. It is contractually obliged to keep your data secure. You can read more in Promolayer’s own privacy disclosures if interested.

  • Email Marketing Provider: As of the date of this Policy, we handle email communications either directly through Wix or manually. However, we anticipate using a dedicated email marketing service (such as Mailchimp or a similar platform) in the future to manage our subscriber lists and send newsletters or promotional emails. If and when we do so, we would provide that service with your name and email (and possibly segmentation info like what you purchased or your region, if we use that for targeting content) to facilitate our communications. Such providers are not allowed to use your information for their own purposes; they simply hold and send out emails as we direct. We will update this Privacy Policy to explicitly name any such provider once in use, and ensure any email service we choose has strong privacy and security practices.

  • Shipping and Delivery Services: If you order physical products from us, we share the necessary information with third parties responsible for delivering your purchases. This typically includes passing your name and shipping address (and occasionally your phone or email for delivery updates) to postal or courier services (for example, USPS, FedEx, UPS, or other local delivery companies). They use this information only for shipping and delivery purposes.

  • Other Vendors: We may rely on other vendors for specific services, such as an external customer relationship management tool, a web analytics provider, or IT support services. We will only share information with these vendors as needed for them to perform their functions, and they are required to keep your information secure and confidential.

  • Business Transfers: In the event that Wild Acres Farmstead undergoes a business transition such as a merger, acquisition by another company, or sale of all or part of our assets, user information (which may include your personal information) is typically one of the assets that may be transferred or acquired by a third party. If such a transfer happens, the successor company will likely continue to use your information in accordance with this Privacy Policy (unless you’re notified of changes). We would inform our customers (for example, via a notice on our Site or email) if their personal information is transferred and becomes subject to a different privacy policy.

  • Legal Compliance and Protection: We may disclose your personal information when required to do so by law or when we believe in good faith that such disclosure is necessary to (a) comply with a legal obligation, legal process, or regulatory request (for example, in response to a court order or a subpoena); (b) enforce our Terms of Service or other agreements; (c) protect and defend the rights, property, or safety of Wild Acres Farmstead, our customers, or others; or (d) investigate or assist in preventing any violation of law or this Privacy Policy, including potential fraud or security issues.

  • With Your Consent: Apart from the reasons above, we will share your personal information with third parties only if you give us consent to do so. For instance, if we ever wanted to feature a customer testimonial on our Site or social media with personal details, we would seek your explicit permission. Or if we plan to share data with a partner for a new service that isn’t covered by this Policy, we would let you know and give you the choice to opt-in.

No Sale of Personal Information: Wild Acres Farmstead does not sell your personal information to third parties for monetary consideration or for their independent use. In other words, we do not provide your data to outside companies for them to market their own products or services to you. We also do not share information for cross-context behavioral advertising (where a company tracks you on other websites to advertise to you) – we simply don’t do that. If this ever changes, we will update this policy and provide any required notices or opt-in/opt-out mechanisms as per the law.

Please note that when we share information with service providers as described above, those third parties may have their own privacy policies that apply to their processing of data. However, they are still only allowed to use the data we provide in order to perform services for us, and must abide by privacy and security obligations. We strive to choose partners who have strong privacy practices. If you have questions about our third-party service providers, feel free to contact us.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which we collected it, and for other legitimate purposes such as complying with legal obligations, maintaining business and financial records, resolving disputes, and enforcing agreements. The exact length of time we keep data can vary depending on the type of information and the context in which it was collected:

  • Account Information: If you create an account on our Site, we will retain the personal information associated with your account for as long as your account is active. If you decide to close your account, or if your account is inactive for an extended period, we may delete the account information after a reasonable time. However, we might retain certain data (like transaction history associated with that account) if needed for our records (see below).

  • Purchase and Transaction Records: We retain records of purchases and transactions you make with us. This is important for purposes such as accounting, tax, and warranty/service obligations. Transaction data (which includes personal information related to the sale, like your name, contact info, and purchase details) is generally kept for the period required by tax law or other applicable laws – often at least seven years in the U.S. for financial records. Even if you request deletion of your personal data, we may be unable to delete transaction records immediately if they are required for legal record-keeping, but we will restrict use of those records to those purposes only.

  • Mailing List and Marketing Info: If you have signed up to receive marketing emails (newsletters, promotions, etc.), we will keep your contact information on our mailing list until you unsubscribe or ask us to remove it. If you unsubscribe, we may keep a limited record (such as your email address) to ensure we honor your opt-out and do not accidentally send you emails again.

  • Communications: If you contact us (via email, contact form, or phone), we may keep those communications and our responses for a period of time, in order to handle any follow-up questions or issues and to train or audit our customer service. Unless required for legal purposes, we typically won't keep routine communications longer than a few years.

  • Website Logs & Analytics: Our web server logs and analytics data may be kept for a shorter period, such as 12-24 months, since they are used for trend analysis and are usually aggregated. Some analytics may retain aggregated info longer, but it’s not personally identifiable at that point.

Once the retention period expires or we no longer have a legitimate business or legal reason to keep your personal information, we will either delete it or anonymize it (so it can no longer be associated with you). For example, we might aggregate data so it’s no longer linked to individuals, and use that for historical analysis.

If deleting certain data is not immediately feasible (for example, if backups are stored in a secure archive), we will store it securely and isolate it from any further active use until deletion is possible.

9. Data Security

The security of your personal information is very important to us. We implement a variety of security measures to protect your data from unauthorized access, disclosure, alteration, and destruction. Here are some key aspects of our security approach:

  • Secure Hosting & Encryption: Our Site is hosted on Wix’s platform, which provides HTTPS encryption (SSL/TLS) for all pages. This means that when you provide information on our Site (such as filling out forms or entering payment details), that information is encrypted in transit between your browser and our servers. Wix’s infrastructure is designed with security in mind, including firewalls and network monitoring to protect against external threats.

  • Payment Information Protection: All payment processing is handled by third-party payment processors (Wix Payments, Square) that are required to follow strict data security standards (PCI-DSS). These standards ensure that credit card data is handled with industry-accepted encryption and security. When you enter payment details, you’re doing so on secure, PCI-compliant servers of those processors. We do not store your full payment card information on our own systems.

  • Access Controls: Within our company, personal information is accessible only to those who need it for their job duties. For example, our staff who prepare orders will have access to your name and address for shipping, but not necessarily your payment details. We protect our administrative logins and accounts with strong passwords and (where possible) multi-factor authentication to prevent unauthorized access.

  • Employee and Contractor Training: We train any team members who handle personal data on best practices and confidentiality obligations. We understand that human error can lead to security issues, so we emphasize care in handling customer information (for instance, not sharing login credentials, recognizing phishing attempts, etc.).

  • Maintaining and Testing Our Systems: We keep our website software, plugins, and tools (including Promolayer) up-to-date to ensure we have the latest security patches. We also utilize security features provided by Wix and our IT tools (such as malware scanning or suspicious login detection). In the event that Wix or another provider alerts us to a potential vulnerability or incident, we act promptly to mitigate any risk.

  • Backup and Recovery: Our data (through Wix) is backed up, which helps protect against data loss. In the case of any accidental data deletion or a security incident leading to data corruption, backups allow us to recover essential information.

Despite all our efforts, it's important to note that no website or Internet transmission is completely secure. There is always some level of risk inherent in sharing data online. We cannot guarantee absolute security of information, but we do our best to protect it. You can also play a part in keeping your data secure: for example, protect your account password and do not share it, and notify us immediately if you suspect any unauthorized access to your account or a security breach.

If a data breach were to occur that affects your personal information, we will act promptly to contain and assess the breach. Where required by law, we will notify you and/or relevant authorities of such breaches. We always aim to learn from any security incidents and further strengthen our defenses.

10. Your Rights and Choices

You have certain rights and choices regarding your personal information. Wild Acres Farmstead is committed to facilitating the exercise of those rights. This section describes the general rights and choices available to all users, followed by additional rights that may apply if you are in California or in the European Economic Area/United Kingdom.

  • Access and Update Your Information: You have the right to access personal information we hold about you and to request corrections or updates to ensure it is accurate. If you have an account on our Site, you can log in and view or update some of your profile information at any time (such as your name, contact details, or shipping addresses). For any information not accessible via your account, or if you don’t have an account, you can make a request to us (see Contact Us below) and we will provide you with a copy of your personal data that we have, or update/correct it as needed.

  • Opt-Out of Marketing Communications: If at any time you wish to stop receiving our newsletter or promotional emails, you can opt out. The easiest way is to click the "Unsubscribe" link at the bottom of any marketing email you receive from us. You can also contact us directly (via email or the contact form) and request to be removed from our marketing list. Please note that even if you opt out of marketing messages, we may still send you important transactional or administrative communications. For example, if you make a purchase, we will send confirmation and shipping emails, and if you have an account, we might send notifications related to security or changes in our services.

  • Cookies and Tracking Choices: As discussed in the Cookies and Tracking Technologies section, you have control over how cookies are used through your browser settings or any cookie consent tool we provide. You can disable non-essential cookies, but note that doing so may impact your experience on our Site. Additionally, you can opt out of certain third-party tracking or analytics services by using their opt-out mechanisms (for example, Google Analytics offers a browser add-on to opt out of its tracking). We currently do not offer a separate opt-out for Do Not Track beyond these measures, because we do not engage in cross-site tracking beyond what’s described.

  • Deletion (Right to Erasure): You may request that we delete personal information we have collected from you. We will honor such requests to the extent required by applicable law (see below for region-specific rights). For example, you can ask us to delete your account or personal data. Keep in mind there may be exceptions – if you’ve made a purchase, we might need to retain certain records for a period of time (as explained in Data Retention) even if you request deletion. We will inform you if any such exceptions apply.

  • Consent Preferences: If we rely on your consent for certain processing (such as sending marketing emails or collecting certain data via cookies), you have the right to withdraw that consent at any time. Withdrawing consent will stop the processing for which consent was given (from that point forward). For instance, if you consented to email marketing, withdrawing consent means we will stop sending you marketing emails. To withdraw consent, you can unsubscribe (for emails) or adjust your browser settings (for cookies), or contact us for assistance.

In addition to these general rights and choices, you may have specific rights under privacy laws depending on where you live. Below we outline additional rights for California residents and for individuals in the European Economic Area (EEA) or equivalent jurisdictions.

11. Privacy Rights for California Residents (CCPA/CPRA)

If you are a resident of California, you are protected by specific privacy rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). These laws provide California residents with, among others, the following rights regarding their personal information (collectively, “CCPA rights”):

  • Right to Know What Information We Collect: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you in the last 12 months. You also have the right to know the sources from which the information was collected, the business or commercial purpose for collecting (or selling/sharing, if applicable) the information, and the categories of third parties with whom we share personal information.

  • Right to Delete: You have the right to request that we delete any personal information we collected from you and retained, subject to certain exceptions. Once we receive and verify your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. Common exceptions include: we may retain information needed to complete your transaction or provide you with the goods/services you requested; to detect security incidents, protect against malicious or illegal activity, or prosecute those responsible; to comply with a legal obligation (such as maintaining records for tax purposes); or for certain internal uses that are compatible with the context in which you provided it (and permitted under law).

  • Right to Correct: You have the right to request that we correct inaccuracies in your personal information that we maintain. If you believe we have incorrect or outdated information about you, you can request a correction. After verifying your identity and validating the request, we will correct the information as you direct (to the extent technically feasible and legally required).

  • Right to Opt-Out of Sale or Sharing of Personal Information: California law gives you the right to opt-out of the “sale” of your personal information or the "sharing" of your personal information for cross-context behavioral advertising. However, Wild Acres Farmstead does not sell personal information to third parties for money, and we do not share your personal information with third parties for cross-site targeted advertising. Because we don’t engage in these practices, there is no need for you to opt out. We treat all user data in line with this Privacy Policy. If that ever changes, we will implement a “Do Not Sell or Share My Personal Information” mechanism as required by law.

  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we won’t deny you our services, charge you a different price, or provide a different level or quality of service just because you exercised your privacy rights. However, please note that if the exercise of your rights limits our ability to process your personal data (for example, if you request deletion of your account data), we may not be able to provide you the full range of services – but we will never punish you with different pricing or services simply for making a request.

Submitting CCPA Requests: If you are a California resident and wish to exercise your Right to Know, Right to Delete, or Right to Correct, you (or an authorized agent acting on your behalf) can submit a request to us through the contact information in the Contact Us section below. Please specify which right you seek to exercise and provide us with enough information to verify your identity. This may include verifying details we already have on file (like your past order information or the email address associated with your account). We will respond to your request within the time frames required by law (generally within 45 days, though we may take an additional 45 days with notice if necessary). We may decline a request in certain cases, as permitted by law — for example, if we cannot verify your identity or if a deletion request is subject to an exception — but we will explain the reasons in our response.

Categories of Personal Information Collected and Disclosed (California Notice of Collection): In the past 12 months, Wild Acres Farmstead has collected the following categories of personal information (as defined by CCPA) from individuals on our Site:

  • Identifiers: e.g., name, email address, postal address, phone number, and IP address.

  • Customer Records (California Civil Code 1798.80(e)): e.g., physical address, telephone number, and payment information (note: payment info is handled by third-party processors as described, but for CCPA categorization we acknowledge collecting some identifiers in transactions).

  • Commercial Information: e.g., records of products purchased, obtained, or considered, and purchasing histories or tendencies.

  • Internet or Other Electronic Network Activity: e.g., browsing history, search history, information on your interaction with our Site or advertisements (though we do not run third-party ads, this includes analytics of how you navigate our Site).

  • Geolocation Data: We infer general location (like city, state) from your IP address when you interact with the Site.

  • Inferences: We may draw inferences from the above information to create a profile reflecting your preferences (for example, inferring what products you might be interested in based on past purchases or pages viewed).

We collect these categories of information from the sources and for the purposes described in this Privacy Policy (see “Information We Collect” and “How We Use Your Information”). We may disclose the above categories of information for business purposes to service providers and other parties as described in “How We Share Your Information” (for example, sharing identifiers and transaction info with our payment processor to complete your order, or sharing identifiers and network activity with Wix for hosting and analytics). We have not sold or shared (for cross-context advertising) any personal information in the past 12 months.

If you have any questions about your California privacy rights, you can always contact us for more information.

12. Privacy Rights for European and International Users (GDPR)

While Wild Acres Farmstead primarily operates in the U.S. and does not specifically target marketing to other countries, our Site is accessible worldwide. If you are located in the European Economic Area (EEA), United Kingdom, or another region with data protection laws (such as the GDPR), you are entitled to certain rights regarding your personal data. We aim to provide you with the same control and transparency over your information, regardless of where you live. Subject to certain conditions and exceptions provided by law, the rights for individuals in the EEA/UK include:

  • Right to Access: You have the right to request a confirmation from us as to whether or not we are processing your personal data. If we are, you have the right to request access to that data (commonly through a "Data Subject Access Request"). We will provide a copy of the personal data we have about you, along with information on how we use it, who we share it with, how long we keep it, and the safeguards that apply if we transfer it outside your jurisdiction.

  • Right to Rectification: You have the right to ask us to correct any inaccurate personal data we hold about you. You can also request us to complete any personal data that is incomplete (taking into account the purposes of processing). As noted earlier, you can update some of your information directly (like in your account profile), and for other changes, you can contact us. We appreciate it when you keep your information up-to-date, so we encourage you to reach out if anything needs to be fixed.

  • Right to Erasure (Right to be Forgotten): You have the right to request that we delete your personal data, under certain circumstances. This right is similar to the deletion right described under CCPA but comes from GDPR. You can request erasure, for example, if the data is no longer necessary for the purposes it was collected, if you have withdrawn consent (and we have no other legal basis to keep processing it), or if you object to processing (see below) and we don’t have overriding legitimate grounds to continue. Keep in mind we might need to retain some information for legal reasons or other exempt purposes – if so, we will inform you.

  • Right to Restrict Processing: In some situations, you have the right to ask us to limit the processing of your personal data. This could apply if you contest the accuracy of the data (for a period enabling us to verify it), if the processing is unlawful and you oppose erasure and prefer restriction, if we no longer need the data but you need it for a legal claim, or if you have objected to processing (pending verification of whether our legitimate grounds override yours). When processing is restricted, we will store your data but not use it (except, for example, to establish or defend legal claims, or to protect another person’s rights) until the restriction is lifted.

  • Right to Data Portability: You have the right to receive personal data that you have provided to us in a structured, commonly used, machine-readable format, and you have the right to transmit that data to another controller (for example, another company), where technically feasible. This right applies when the processing is based on your consent or a contract with you, and when done by automated means. In plain terms, if you provided us data and we use it electronically with your consent or to fulfill a contract, you can ask for a copy in a format like CSV or JSON so you can reuse it elsewhere.

  • Right to Object: You have the right to object to certain types of processing. You can object to direct marketing at any time (and as mentioned, you can opt out easily via our emails). You can also object, on grounds relating to your particular situation, to processing that we base on our “legitimate interests” (see below for what those are) or for tasks in the public interest or exercise of official authority (which we do not engage in). If you lodge an objection, we will stop processing the personal data unless we have compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or unless we need to continue processing for the establishment, exercise, or defense of legal claims.

  • Right to Withdraw Consent: If we are processing your personal data based on your consent, you have the right to withdraw that consent at any time. This will not affect the lawfulness of any processing that occurred before you withdrew consent. For example, if you consented to receive newsletters, you can withdraw that consent and we will stop sending you newsletters; the emails we already sent while you were consented were lawful.

  • Right to Lodge a Complaint: If you believe that we have infringed your data protection rights, you have the right to complain to a supervisory data protection authority. If you are in the EEA, you can contact the authority in the country where you live, where you work, or where you believe the infringement occurred. If you are in the UK, you can contact the Information Commissioner’s Office (ICO). We would, however, appreciate the chance to address your concerns directly before you do this, so we encourage you to contact us first if possible.

Legal Bases for Processing (EEA/UK users): The GDPR requires us to tell you the legal basis on which we process your personal data. Depending on the specific situation, our processing of your data may rely on one or more of the following bases:

  • Performance of a Contract: Many times, we process your data because it is necessary to fulfill our contract with you or to take steps at your request before entering a contract. For example, when you buy something from our Site, we must process your personal data (name, address, payment info) to complete the sale and deliver your product. Likewise, if you request information or contact us with questions, we process that data as part of providing the service you requested.

  • Consent: In some cases, we rely on your consent to process personal data. The most common example is email marketing – we only send you promotional emails if you have consented (such as by signing up for our newsletter or checking an opt-in box during checkout). Another example is non-essential cookies, which, in jurisdictions that require it, we will only use if you consent (via a cookie banner). If we ask for consent, you have the right to withdraw it as noted above.

  • Legitimate Interests: We process certain data as necessary for the pursuit of our legitimate interests, provided that those are not overridden by your rights and interests. Our legitimate interests include: improving and ensuring the proper functioning of our business, Site, and services; understanding our customers and market trends; securing our systems and preventing fraud; and marketing our products to customers (including mild personalization of the experience, like recommending products). When we process on this basis, we make sure to consider and balance any potential impact on you (both positive and negative) and your rights under data protection laws. We do not use your data for activities where our interests are overridden by the harm to your privacy (for instance, we would not unjustifiably profile you or sell your data under this basis).

  • Legal Obligation: Sometimes we need to process data to comply with a legal obligation, such as keeping records for tax purposes, responding to legal process, or honoring your exercise of data rights.

International Data Transfers: If you are located outside the United States, please be aware that we are based in the U.S. and the personal information we collect will be transferred to and processed in the United States (or other countries where our service providers are located, such as Israel for Wix’s main offices, or other jurisdictions where Wix/Square might maintain servers). These countries may have data protection laws that are different from those in your country of residence and may not be deemed “adequate” by the European Commission. However, we take steps to ensure that your personal data is treated securely and in accordance with this Privacy Policy and applicable law. For example, when Wix (which is an Israeli/U.S. company) or other service providers process EU/UK data, they may do so under standard contractual clauses or other approved transfer mechanisms that legally permit the transfer of data from the EEA/UK to other countries. By using our Site or providing us with your information, you understand that your data will be transferred to the U.S. (and potentially other countries) as needed to provide our services. We will protect it as described here, regardless of where it is processed.

To exercise any of your GDPR rights, please contact us with your request (see Contact Us below). We may need to verify your identity before actioning your request, and we will respond within the time period required by law (usually one month, with the possibility to extend by two further months in certain complex cases). Exercising these rights is free of charge unless a request is manifestly unfounded or excessive, in which case we may charge a reasonable fee or refuse the request.

13. Children’s Privacy

No Collection from Children Under 13: Our Site and services are intended for use by adults and we do not direct any content specifically at children under 13 years of age. In compliance with the U.S. Children’s Online Privacy Protection Act (COPPA) and other applicable laws, we do not knowingly collect personal information from children under 13. If you are under 13, please do not submit any personal information to us (including your name, address, email, or phone number). If we learn that we have inadvertently collected personal data from a child under 13, we will promptly take steps to delete that information from our records.

Parental Guidance for Minors 13-17: If you are between 13 and the age of majority in your jurisdiction (typically 18 in most states), you should use our Site only with the involvement and consent of a parent or guardian. While our content is generally family-friendly (we’re a farm business), transactions and account creations should be done by adults. We encourage parents to supervise their children’s online activities and to help enforce this Privacy Policy by instructing their children never to provide personal information without permission.

California Minors’ Right to Remove Information: If you are under 18 and a registered user of our Site (which again, would only occur with guardian permission, as our primary stance is no users under 13), California law (Cal. Bus. & Prof. Code § 22581) permits you to request removal of content or information you have publicly posted. If applicable, you can make such a request by contacting us with the details of what you want removed. Note that this doesn’t ensure complete or comprehensive removal (for example, others might have reposted your content), but we will do our best to anonymize or remove the content you request, as required by law.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other purposes. When we make changes, we will post the updated Privacy Policy on our Site and update the "Last Updated" date at the top. If the changes are significant, we may also provide a more prominent notice or seek your consent as required by law – for example, by emailing you (if we have your email) or by placing a notice on our homepage.

Your continued use of our Site after any changes to this Privacy Policy indicates your acknowledgment of the changes and your agreement to the updated terms. We encourage you to periodically review this Privacy Policy to stay informed about how we are protecting the personal information we collect. If we make a material change to how we use personal information that we’ve already collected from you, we will seek your consent for that new use if required by applicable law.
